PUBLIC NOTICE WOODCOCK BOROUGH, CRAWFORD COUNTY Notice is hereby given that the Council of Woodcock Borough, Crawford Co., Pa. intends to consider and enact an Ordinance entitled An Ordinance Regulating the Accumulation, Storage, Collection and Disposal of Garbage, Refuse, Waste, and Junk; Regulating the Keeping of Domesticated Chickens, Turkeys, Rabbits, and Other Small Animals; Prohibiting the Establishment and Maintenance of Nuisances Within the Borough; Providing Remedies for Violations of the Ordinance Including Penalties and Proceedings for Abatement of Nuisances at its regular meeting on Wednesday, July 2, 2014 at 7:30 p.m. at the Borough building at Heist Park, 23366 Gravel Run Rd. in Saegertown. A summary follows: Section 1: Title. Section 2: Purpose is to prevent conditions likely to pose a threat to public health/safety or create a public nuisance. Section 3: Definitions. Section 4 prohibits the following: accumulation, storage, processing or disposal of refuse/garbage/junk on or about property and maintaining of a junk yard within the Borough, except as permitted under the provisions of the Ordinance or other applicable laws/ regulations. Section 5 prohibits establishing/ maintaining conditions on property or activities found to constitute a nuisance, including: storage/accumulation of garbage/waste /junk; discharge/ drainage/storage of offensive liquid waste substances into grounds or waters excepting properly permitted facilities; maintaining conditions on premises which promote growth and harboring of insects/rodents/vermin; burning tires/tar products; maintaining dangerous structures; allowing uncovered wells/ cisterns; maintaining abandoned refrigerators/freezers outdoors with the doors attached; allowing weeds/ plant growth in excess of 10; allowing noxious weeds; defacing exterior of structures on private/ public property; and other conditions which threaten public health/safety/ welfare. Section 6 establishes standards for storage of refuse/garbage for collection. Section 7 establishes the standards for disposal of refuse/garbage by composting, burning and by utilizing waste collector services. Section 8 establishes regulations for junk yards within the Borough, requiring the screening/enclosure of junk yards; minimum 75 setback from streets/roads/property lines; requiring stacking of junk vehicles/ parts; arranging junk to facilitate access for fire fighting purposes; sheltering material subject to decomposition/ decay; prohibiting storage/placement/maintenance of junk within 200 of rivers/streams/creeks/other natural watercourses; and prohibiting burning of junk except as permitted by Section 7. Section 9 declares certain conduct unlawful, such as: keeping domesticated chickens/ turkeys/rabbits on premises within the Borough except as permitted/regulated by the ordinance; allowing domesticated chickens/turkeys/rabbits or other small animals to run at large; keeping domesticated chickens/ turkeys/rabbits or other small animals so as to create offensive odors, excessive noise or unsanitary conditions; and allowing domesticated chickens/turkeys/rabbits or other small animals to destroy or damage property other than property of the owner or person in charge/ control of such animals. Section 10 establishes standards for keeping of domesticated chickens/turkeys/ rabbits, including pens/housing standards; nutrient management and pest control standards; requires owner(s) of such animals reside on the property on which they are kept; and requires that outdoor slaughtering of such animals be performed out of public view. Section 11: Enforcement. Section 12 permits entry of properties to inspect premises for compliane. Section 13: Written notice of violation to the owner of premises. Section 14: summary offense penalty shall be fine between $100 and $1,000 plus costs upon conviction for violating any provision; imprisonment between 10 and 30 days upon default of payment; each days violation constitutes a separate offense. Section 15: Remedies for violation: prosecution of a summary offense before the District Magistrate, and/or bringing a civil action in court; remedies are not mutually exclusive and may be employed simultaneously or consecutively. Section 16 establishes procedure for and permits immediate correction/remedy without notice of violations that immediately endanger life or safety; costs of such correction/ remedy, including reasonable attorneys fees and costs shall be charged against the land as a municipal lien or recovered in a suit at law or manner. Section 17 repeals inconsistent ordinances. Section 18 severs provisions found invalid. Section 19: Effective on Mayors approval.
